Federal Court: Nebraska's Anti-Gay-Union Ban Unconstitutional

A federal district court today struck down Section 29 of the Nebraska Constitution, passed by voters in 2000, as an unconstitutional violation of equal protection.

Section 29 of the Nebraska Constitution provides that �[o]nly marriage between a man and a woman shall be valid or recognized in Nebraska. The uniting of two persons of the same sex in a civil union, domestic partnership, or other similar same-sex relationship shall not be valid or recognized in Nebraska.� Neb. CONST. art. I, � 29.
