Divided three-judge panel of the U.S. Court of Appeals for the Seventh Circuit holds that, under Blakely v. Washington, judicial application of the Sentencing Guidelines violates the defendant's right to trial by jury under the Sixth Amendment: This is big, big news. This afternoon's decision, issued in typescript, can be accessed here. Circuit Judge Richard A. Posner wrote the majority opinion, in which Circuit Judge Michael S. Kanne joined, and Circuit Judge Frank H. Easterbrook wrote a dissenting opinion.

UPDATE: There is (and will continue to be) lots of discussion about this latest development at Sentencing Law And Policy, The Blakely Blog, and TalkLeft (one of whose authors, TChris, represented the defendant in the case).
